The surplus meetings scheduled for this week have been cancelled. They will likely be rescheduled next week. The company needed more time to consider the lists and we agree it was moving too fast. We do not know if the flawed process will be corrected or if we will have to file grievances. We will keep you posted.

We believe the surplus currently being processed in C&E is being mishandled by the company. We have tried to discuss the issue with the contacts we have but have been unable to move them from their positions. We are now working with the District office in Atlanta. We will keep you posted.

Until then we will follow the process and file grievances. And we will remember how they treat us.

Contracting Out Placement of Buried Service Wire

The District Office reported that an arbitrator sustained the Union’s grievance challenging the Company’s decision to contract out the placement of buried service wire in right-of-ways. As part of her analysis, the arbitrator concluded that the Company violated the contract when it (1) failed to give any notice to CWA of its intent to contract out; (2) failed to offer unlimited overtime before contracting out; and (3) failed to refrain from laying-off employees as a result of contracting out.

The arbitrator has remanded the case back to the parties for negotiation of a remedy, and also retained jurisdiction in the event the parties are not able to reach agreement on the remedy.
